Diese Bedingungen regeln die Nutzung der Software, die Lowegate Studio (Samuel La Manna, Bäckergasse 1, 82285 Hattenhofen, Deutschland) auf dem OrionEye-USB-Stick oder für Enterprise-Installationen bereitstellt: OrionEye Client, OmniAgent OS, SentraLink, die zugehörigen Dienste und Skripte sowie deren Updates (die „Software“). Ergänzend gelten die Nutzungs- und Abonnementbedingungen.
Der Kunde erhält für die Dauer seines Abonnements ein einfaches, nicht übertragbares und nicht unterlizenzierbares Recht, die Software zu eigenen Zwecken zu nutzen: bei Pro auf eigenen Rechnern zusammen mit dem persönlichen USB-Stick, bei Enterprise im vertraglich vereinbarten Umfang.
Soweit nicht gesetzlich erlaubt (insbesondere §§ 69d, 69e UrhG), ist es nicht gestattet, die Software zu vervielfältigen, zu verändern, zu dekompilieren oder zurückzuentwickeln, sie zu vermieten, weiterzugeben oder unterzulizenzieren, Urheber- und Lizenzhinweise zu entfernen oder die Bindung an den USB-Stick und die Lizenzprüfung zu umgehen. Eine Sicherungskopie ist erlaubt, soweit sie für die Nutzung erforderlich ist.
Die Software enthält Open-Source-Komponenten, die ihren eigenen Lizenzen unterliegen. Diese sind in der Datei THIRD-PARTY-NOTICES.txt auf dem USB-Stick und online aufgeführt. Rechte aus diesen Lizenzen werden durch diese Bedingungen nicht eingeschränkt.
OrionEye Client kann Updates der Software vom USB-Stick installieren. Es werden nur vom Anbieter signierte Pakete installiert. Automatische Installationen kann der Kunde in den Einstellungen abschalten.
Die Software läuft auf dem Rechner des Kunden. Über die Anmeldung und die Lizenzprüfung hinaus werden Betriebsdaten nur übermittelt, wenn der Kunde dem zustimmt; die Zustimmung ist widerruflich. Einzelheiten enthält die Datenschutzerklärung.
Das Nutzungsrecht endet mit dem Abonnement oder bei schwerwiegendem Verstoß gegen diese Bedingungen. Danach wird die Software nicht mehr genutzt; die Zugangsdaten des USB-Sticks werden gesperrt.
Für Gewährleistung und Haftung gelten die Nutzungs- und Abonnementbedingungen. Es gilt deutsches Recht.

La presente licenza regola l'uso del software che Lowegate Studio (Samuel La Manna, Bäckergasse 1, 82285 Hattenhofen, Germania) fornisce sulla chiavetta USB OrionEye o per le installazioni Enterprise: OrionEye Client, OmniAgent OS, SentraLink, i servizi e gli script collegati e i relativi aggiornamenti (il «Software»). Valgono inoltre le condizioni d'uso e di abbonamento.
Per la durata dell'abbonamento il cliente riceve un diritto semplice, non trasferibile e non sublicenziabile di usare il Software per i propri scopi: con Pro sui propri computer insieme alla chiavetta personale, con Enterprise nei limiti del contratto.
Salvo quanto la legge consente (in particolare §§ 69d e 69e della legge tedesca sul diritto d'autore), non è permesso copiare, modificare, decompilare o decodificare il Software, noleggiarlo, cederlo o concederlo in sublicenza, rimuovere gli avvisi di copyright e di licenza o aggirare il legame con la chiavetta e il controllo della licenza. È consentita una copia di sicurezza, se necessaria all'uso.
Il Software contiene componenti open source soggetti alle proprie licenze, elencati nel file THIRD-PARTY-NOTICES.txt sulla chiavetta e online. La presente licenza non limita i diritti concessi da quelle licenze.
OrionEye Client può installare aggiornamenti del Software dalla chiavetta. Installa solo pacchetti firmati dal fornitore. Il cliente può disattivare le installazioni automatiche nelle impostazioni.
Il Software gira sul computer del cliente. Oltre all'accesso e alla verifica della licenza, i dati di funzionamento vengono trasmessi solo con il consenso del cliente, revocabile. I dettagli sono nell'informativa privacy.
Il diritto d'uso termina con l'abbonamento o in caso di grave violazione della presente licenza. Da quel momento il Software non va più usato e le credenziali della chiavetta vengono bloccate.
Per garanzia e responsabilità valgono le condizioni d'uso e di abbonamento. Si applica il diritto tedesco.

These terms govern the use of the software that Lowegate Studio (Samuel La Manna, Bäckergasse 1, 82285 Hattenhofen, Germany) provides on the OrionEye USB key or for Enterprise installations: OrionEye Client, OmniAgent OS, SentraLink, the related services and scripts and their updates (the “Software”). The Terms of Use and Subscription also apply.
For the duration of the subscription the customer receives a simple, non-transferable and non-sublicensable right to use the Software for their own purposes: with Pro on their own computers together with the personal USB key, with Enterprise within the scope agreed in the contract.
Except as permitted by law (in particular §§ 69d and 69e of the German Copyright Act), it is not permitted to copy, modify, decompile or reverse engineer the Software, to rent, transfer or sublicense it, to remove copyright and licence notices, or to circumvent the binding to the USB key and the licence check. One backup copy is permitted where necessary for use.
The Software contains open-source components subject to their own licences, listed in the THIRD-PARTY-NOTICES.txt file on the USB key and online. These terms do not restrict the rights granted by those licences.
OrionEye Client can install Software updates from the USB key. Only packages signed by the provider are installed. The customer can switch off automatic installation in the settings.
The Software runs on the customer's computer. Beyond sign-in and licence verification, operating data is transmitted only with the customer's consent, which can be withdrawn. Details are in the privacy policy.
The right of use ends with the subscription or upon a serious breach of these terms. The Software must then no longer be used, and the USB key credentials are blocked.
Warranty and liability are governed by the Terms of Use and Subscription. German law applies.
